Terms of Service

These Terms of Service govern your access to and use of the Kisscat Studio website and services. By accessing this website, you agree to be bound by these terms and our Privacy Policy.

Eligibility

  • You must be at least 18 years old (or the age of majority in your jurisdiction).
  • You may not access this website from a location where adult content is illegal.
  • You must provide accurate account and billing information.

Studio Credits

  • Studio Credits are closed-loop account value that can be used only to buy eligible Kisscat Studio digital content or access. One Studio Credit has a checkout value of US$1.
  • Credits are not a bank account, deposit, cryptocurrency, or general-purpose payment instrument. They cannot be transferred between users, withdrawn, resold, exchanged for cash, or used outside Kisscat Studio, except where a refund or cash remedy is required by applicable law.
  • You may add purchased Credits through an available third-party payment processor. Processor, blockchain, network, exchange-rate, or similar fees may be added to the amount you send and are not added to your Studio Credit balance.
  • Purchased Credits normally remain available while your account is active. We may correct Credits credited by mistake or reverse Credits connected with a refunded, reversed, fraudulent, or unauthorized payment. Promotional Credits may expire if their expiry was clearly disclosed.
  • Your balance and transaction history are shown in your account. You must not exploit rounding, concurrency, payment-webhook, chargeback, or other technical errors to obtain unearned Credits or access.
  • If your balance is insufficient, checkout may offer “Top up & buy”. Before leaving for payment, you will be shown the order total, top-up amount and expected remaining balance and asked to authorize both the top-up and the automatic Studio Credit purchase after the top-up is confirmed. That authorization applies only to the listed videos and disclosed prices, expires after 48 hours, and is processed once.
  • If an authorized automatic purchase cannot be completed, for example because content is withdrawn or a price or availability check fails, no video debit is made for the failed purchase and confirmed Credits remain in your Studio balance. Any amount left after a completed automatic purchase also remains in your balance.
  • An account with a positive purchased-Credit balance cannot normally be deleted through self-service. Spend the balance or contact support@kisscat.xyz so that any mandatory rights can be handled first.

Membership and Billing

  • Subscription price: $19.99/month.
  • Studio VIP may be purchased directly through an available payment processor or paid from Studio Credits. The checkout identifies whether the offer is a recurring subscription or a fixed access period.
  • A VIP period bought from Studio Credits is a one-time, non-recurring purchase. It does not automatically renew and no further Credits are deducted unless you make another purchase.
  • If a checkout expressly identifies recurring billing, you authorize us and our payment processor(s) to charge the selected payment method at the disclosed interval until cancellation.
  • Before payment, you may be asked to expressly request immediate activation and supply of Studio VIP digital content and acknowledge that your statutory cancellation right will be lost once supply begins.
  • Where recurring billing applies, cancellation stops future renewal but does not create a prorated refund or Credit for the current paid period. Viewing content, not using the service, forgetting to cancel, or dissatisfaction with available content are not grounds for a refund, subject always to mandatory consumer rights.

One-Time Video Purchases

  • Published videos may be purchased separately as digital content for the one-time price shown on the video page. Video purchases are paid from your Studio Credit balance.
  • A completed purchase grants you a personal, non-exclusive, non-transferable, non-sublicensable, non-commercial and non-expiring licence to download, store and privately view the purchased video, provided the transaction is not refunded or reversed and you comply with these Terms.
  • A purchase is not a sale or assignment of copyright or any other intellectual-property right. The video and all copyright and related rights remain owned or licensed by GERSOG DIGITAL MEDIA LTD and its licensors.
  • You must not share, upload, publish, distribute, lend, rent, resell, sublicense, publicly perform, commercially exploit, or help another person obtain the video, and you must not circumvent access controls.
  • After the Studio Credit purchase is confirmed, access and a download option are normally made available without delay. You should download the video promptly and keep your own lawful backup.
  • The personal gallery and repeat-download facility are provided as a convenience and are not a permanent cloud-storage or backup service. We do not promise that hosted access or re-downloads will remain available indefinitely. They may become unavailable because of account deletion, service closure, technical or security incidents, legal or regulatory requirements, rights disputes, content removal, or events outside our reasonable control.
  • Loss of hosted or gallery access does not by itself end the licence for a copy you lawfully downloaded, but we may be unable to replace a copy you lose. Deleting your account removes gallery access and download authorization.
  • At checkout, you may be asked to expressly request immediate supply of the digital content and acknowledge that, once supply begins after payment, any statutory right to cancel merely because you changed your mind will be lost. This does not affect your mandatory rights where digital content is faulty, not as described, or otherwise non-conforming.
  • If a purchase is refunded, charged back, or otherwise reversed, the licence ends and you must delete all copies in your possession or control, except where applicable law requires otherwise.

Cancellation

  • You may cancel a recurring subscription at any time from your account settings.
  • Cancellation takes effect at the end of the current paid billing period unless otherwise stated.
  • Fixed VIP periods purchased from Studio Credits do not recur and therefore do not need cancellation.
  • We do not provide refunds for partial billing periods.

Prohibited Content and Conduct

  • No content involving minors, non-consensual acts, or illegal activity.
  • No harassment, abuse, or attempts to breach site security.
  • We reserve the right to terminate accounts that violate these rules.

License and Intellectual Property

  • All content on this website is owned or licensed by GERSOG DIGITAL MEDIA LTD.
  • You may not copy, distribute, or publicly display content without written permission.
  • Downloaded purchased videos are for the purchaser's private personal use only.

Disclaimers

  • The service is provided on an “as is” and “as available” basis.
  • We do not guarantee uninterrupted access or error-free service.
  • These disclaimers do not exclude any standard, quality, description, remedy, or other right that cannot lawfully be excluded for digital content.

Limitation of Liability

  • GERSOG DIGITAL MEDIA LTD shall not be liable for indirect, incidental, or consequential damages.
  • For a one-time video purchase, our total liability relating to that purchase is limited to the amount paid for the affected video, to the extent permitted by law.
  • Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud or fraudulent misrepresentation, or for death or personal injury caused by negligence.

Governing Law and Disputes

  • These Terms are governed by the laws of England and Wales.
  • The courts of England and Wales have jurisdiction over disputes, subject to any mandatory rights you have under the law of the country where you live.
  • Nothing in these Terms excludes or limits rights or remedies that cannot lawfully be excluded, including mandatory consumer rights.
